Chew the Fat ("CTF") respects the privacy of its users whether they use the CTF website ("Site") to participate in interactive debates or simply view the Site. The following CTF privacy policy ("Privacy Policy") is designed to inform you, as a user of the Site, about the types of information that CTF may gather about or collect from you in connection with your use of the Site. It also is intended to explain the conditions under which CTF uses and discloses that information, and your rights in relation to that information.

Changes to this Privacy Policy are discussed at the end of this document. It applies to all interactions with the Site, including interactions with the Site through buttons and widgets. It also applies to mobile applications produced by CTF. Each time you use the Site, however, the current version of this Privacy Policy will apply and your use of the Site after such changes are implemented constitutes your acknowledgement and acceptance of the changes. Accordingly, each time you use the Site you should check the date of this Privacy Policy (which appears at the end of this document) and review any changes since the last time you used the site. Additionally, our Privacy Policy is part of our Terms of Use and by using the Site you agree to both.

INFORMATION COLLECTION AND USE

Collection, Use and Disclosure of Personal Information

"Personal Information" means any information that may be used to identify an individual, including, but not limited to, a first and last name, a home or other physical address and an email address or other contact information, whether at work or at home.

In general, you can visit the Site without telling us who you are or revealing any Personal Information about yourself. However, you may be asked to provide Personal Information if you would like to participate in certain features of the Site.

CTF collects a range of Personal Information from and about Site users. Much of the Personal Information collected by CTF about users is information provided by users themselves at the time they register with the Site. That information includes each user’s email, first and last name, gender, birthday and country.

Certain Personal Information collected from users is disclosed as a matter of course as a result of those users’ use of the Site. USERS ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM THEIR VOLUNTARY DISCLOSURE OF PERSONAL INFORMATION.

Information Collected Upon Registration

If you desire to have access to certain restricted sections of the Site or to have access to or use of certain parts of the Site, you will be required to become a registered user, and to submit certain Personal Information to CTF. Personal Information that we may collect in such instances may include your full display name, email address, password, city, time zone, telephone number, and other information that you decide to provide us with, or that you decide to include in your public profile. Providing additional information beyond what is required at registration is entirely optional, but enables you to better identify yourself and utilize the Site. We also collect Personal Information when you contact us online for customer service and other support using self-help tools, such as email, text, or by posting online.

Location Data

Your use of a mobile version of the Site may provide CTF with information regarding your actual location. CTF will collect this information only if you allow CTF to access your location through your mobile device. Additionally, CTF receives location information from the Social Media Sites (as defined below) that you enable within the mobile version of the Site and also (with your permission) from your device ("Geo-location Data"). We may use Geo-location Data to complete your CTF profile (for example, to indicate that you are located in Chicago), customize the Site to make it more relevant to you (for example, to show you topics in your area) and to offer you location-relevant services.

Third Parties

Any Personal Information you provide to any other third party is provided directly to that third party and is subject to that third party’s privacy policy. Except as described above, CTF is not responsible for the content or privacy practices of third parties. We encourage you to learn about the privacy practices of those third parties before providing them with Personal Information. If you have registered using a Social Media Site, CTF follows the privacy policy of the Social Media Site.

Log Data

When you interact with our Site or use our Site, our servers automatically receive and store certain personally non-identifiable information ("Log Data"). This Log Data is collected passively and may include information such as your IP address, browser type or the domain from which you are visiting, the Site pages you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use Log Data to provide you with the Site and pool it with other information to monitor the use of the Site, and for the technical administration of the Site. We do not associate your IP address with any other Personal Information to identify you personally, except in cases where we are asked to comply with a subpoena or other legal demand or where we suspect that there has been a violation of our policies, our Terms of Use or applicable law.

Cookies

Like many websites and services, we also use "cookie" technology to collect additional Site usage data and to improve the Site. A cookie is a small data file that we transfer to your computer’s hard disk. We do not use cookies to collect Personal Information. Also, our cookies only collect information with respect to your visits to and actions on our Site. CTF may use both session cookies and persistent cookies to better understand how you interact with the Site, to monitor aggregate usage by our users and web traffic routing on the Site, and to improve the Site. A session cookie enables certain features of the Site and is deleted from your computer when you disconnect from or leave the Site. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser help file directions. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.

Statistical Information

"Personal Information" does not include statistical information. By analyzing your use of our system we may compile certain statistical information, such as anonymous information about how users use our service. In addition, when you use the Site certain statistical information may be gathered about your usage and used for diagnostic purposes and improving CTF. This may include certain information that CTF automatically receives from your mobile device, such as time patterns and feature usage. Statistical data helps understand trends and customer needs so that new products and services can be considered and in order to tailor existing products and services to customer desires. Aggregate statistical information is anonymous and will not be linked to any Personal Information for provision to third parties. We may share such anonymous statistical information with our partners, without restriction, on commercial terms that we can determine in our sole discretion.

Posts, Comments and Message Data

The posts and comments made by users on CTF are not private, even if made to a forum not readily accessible to the public. This means that, by default, they are not deleted from our servers – ever – and will still be accessible after an account is deleted. User messages are generally only viewable by the parties involved, but they may be accessed internally as needed for community support. Moreover, CTF keeps a complete log of all messages sent on the Site, even when both parties later delete their accounts. CTF stores the IP addresses associated with specific posts, comments, and private messages for 90 days after they are made or sent.

USE OF INFORMATION

CTF uses the Personal Information you provide in a manner that is consistent with this Privacy Policy. We will use your Personal Information in order to provide you with access to and use of our Site, to help us improve the content and functionality of the Site and to better understand our users. The information you provide will be used to support your customer relationship with CTF. CTF also uses the information to prevent potentially illegal activities, and to enforce our Terms of Use. For example, CTF asks for your date of birth to verify that you are over age 18. We also use a variety of technological systems to detect and address anomalous activity and screen content to prevent abuse such as spam. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some users.

Your information may be shared with agents, contractors or business partners for the purpose of performing services for CTF. If you contact us by email through the Site, we may keep a record of your contact information and correspondence, and may use your email address, and any information that you provide to us in your message, to respond to you.

In addition, we may use your contact information to market to you, and provide you with information about our products and services and the products and services of our partners that we believe may be of interest to you. If you decide at any time that you no longer wish to receive such marketing information or communications from us, please follow the unsubscribe instructions provided in any of the communications or contact us at contact@chewthefat.com.

In an ongoing effort to better understand and serve the users of our Site, CTF also conducts research on its customer demographics, interests and behavior based on the Personal Information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and CTF may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. CTF may also disclose aggregated user statistics in order to describe our Site to current and prospective business partners, and to other third parties for other lawful purposes.

INFORMATION SHARING AND DISCLOSURE

We consider your information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third parties without further notice to you, as set forth below:

When We Have Your Consent.

When you create a profile, your username and any other information that you share on your profile page will be public and may be viewed by anyone. By creating a profile and registering to use the Service, you are consenting to this public disclosure of the information in your profile. You can adjust the information in your profile and your privacy settings at any time in your account settings.

Service Providers

We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your Personal Information with these third parties, but only to the extent necessary to perform these functions and provide such services.

Social Media Site

You can choose to access certain third party social media Web sites and services through our Site (such as Twitter or Facebook) ("Social Media Sites"). When you do so, you are sharing information with those Social Media Sites, and the information you share will be governed by their privacy policies and terms of service. You may also be able to modify your privacy settings with these Social Media Sites to, for example, control what information the Social Media Sites disclose to third parties like CTF. When you add Social Media Sites accounts to the Site or log into the Site using your Social Media Site account, we will collect relevant information necessary to enable our Site to access that Social Media Site, but you will provide your login information, like your password, directly to such Social Media Sites (and not to CTF). As part of such integration, the Social Media Sites will provide us with access to certain information that you have provided to such Social Media Sites, and we will use, store and disclose such information in accordance with this Privacy Policy and, if and to the extent applicable, the policies of such Social Media Sites. However, please remember that the manner in which Social Media Sites use, store and disclose your information is governed by the policies of such third parties, and CTF shall have no liability or responsibility for the privacy practices or other actions of any Social Media Sites that may be enabled within the Site.

Advertisers

CTF may use your Personal Information to personalize some of our services and products for you and to deliver targeted advertisements and offers from CTF, its affiliates, and from third parties. In addition, CTF may institute programs with advertising partners and other websites in which they share information with us. CTF may ask advertisers to tell CTF how users responded to the ads CTF showed them (and for comparison purposes, how other users who didn’t see the ads acted on their site). This data sharing, commonly known as "conversion tracking," helps us measure CTF’s advertising effectiveness and improve the quality of the advertisements users see. CTF may receive information about whether or not you’ve seen or interacted with certain ads on other sites in order to measure the effectiveness of those ads.

CTF allows advertisers to choose the characteristics of users who will see their advertisements. CTF may display targeted advertisements based on your Personal Information. Advertisers may assume that people who interact with, view, or click on targeted ads meet the targeting criteria—for example, women ages 18-24 from a particular geographic area.

CTF does not provide any Personal Information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad. Also, when you click on or otherwise interact with an advertisement there is a possibility that the advertiser may place a cookie in your browser and note that it meets the criteria they selected.

Certain Communications Directed to CTF

By submitting a DMCA Notice of Infringement pursuant to our Terms of Use or any other communication (including communications about content stored on or transmitted through the Site) you consent to have such communication forwarded to the person or entity who stored, transmitted or linked to the content addressed by your communication, in order to facilitate a prompt resolution. For notices of violations of our Terms of Use or other communications (but not DMCA Notice of Infringement), upon request CTF will edit out your name and contact information. However, DMCA Notices of Infringement (including any personally identifying information set forth in the Notifications) will be forwarded as submitted to CTF without any deletions.

Business Transfers

CTF may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization, change of control transaction, sale of assets or in the event of bankruptcy. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personal Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt-out of it. Personal Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.

Disclosures for Legal Purposes

CTF may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of CTF, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.

PRIVACY SETTINGS

You can request the Personal Information that CTF has collected about you, correct factual inaccuracies in your Personal Information, remove Personal Information from CTF’s databases and/or update your Personal Information here or by contacting us at contact@chewthefat.com.

SECURITY

CTF is very concerned about the security of your Personal Information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access. However, no Internet or email transmission is ever fully secure or error free. We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal Information to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

LINKS TO OTHER WEBSITES

Our Site may contain links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personally identifiable information from you. Other sites follow different rules regarding the use or disclosure of the personally identifiable information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

USE OF CTF BY CHILDREN

CTF does not knowingly collect personally identifiable information from children under the age of 13, and you must be 18 years of age or older in order to use the Site and establish an account. In the event you become aware that an individual under the age of 18 has enrolled without parental permission, please advise us immediately.

OTHER TERMS AND CONDITIONS

Your access to and use of the Site is subject to the Terms of Use.

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. To request a copy of the information disclosure provided by CTF pursuant to Section 1798.83 of the California Civil Code, please contact us via the email or address stated above. Please allow 30 days for a response.

CHANGES TO THIS PRIVACY POLICY

The Site and our business may change from time to time. As a result, at times it may be necessary for CTF to make changes to this Privacy Policy. This Privacy Policy may be updated or modified from time to time for any reason without prior notice. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy on our Site or by emailing you. This Privacy Policy was last updated on the date indicated below. Your continued use of the Site after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
